This case was scheduled for trial at the Court's upcoming trial session beginning September 6, 2022, in Detroit. On August 1, 2022, the Commissioner filed a motion (Doc. 11) for a continuance of trial, stating that the case is susceptible of settlement but that petitioner's views on the motion were not known. By order of August 2, 2022 (Doc. 12), we ordered petitioner Nicholas Michael Caputo to file a response to the motion by August 12, 2022. He did not do so. It is

ORDERED that the motion is granted, that this case is continued and stricken from the calendar of the Court's upcoming Detroit trial session, and that this case is restored to the general docket, to be scheduled for trial in due course at a future session.
