Capone v. Osmun

Appellate Division of the Supreme Court of New York, Fourth Department
May 5, 1943
266 App. Div. 820 (N.Y. App. Div. 1943)

Opinion

May 5, 1943.

Present — Crosby, P.J., Cunningham, Dowling, Harris and McCurn, JJ.

Judgment and order affirmed, with costs. All concur, except Crosby, P.J., who dissents and votes for reversal and for granting a new trial on the ground that the verdict was against the weight of the evidence. (The judgment is for plaintiff against defendants Salina Chevrolet Company and Dellaquilla for $2,000, and in favor of defendant Osmun for no cause of action in an automobile negligence action. The order denies defendants' motion for a new trial.)
