CAPE COD BANK TRUST CO. v. GENEVRINO

Massachusetts Appellate Division, Southern District
Nov 6, 1991
1991 Mass. App. Div. 175 (Mass. Dist. Ct. App. 1991)

Opinion

November 6, 1991.

Present: Dolan, P.J., Hurley Martin, JJ.

Bills and Notes, Promissory note. Practice, Civil, Summary judgment.

Report of court's dismissal of defendant's report. Action heard in the Orleans Division by John P. Curley, Jr., J.

Richard A. Larajo for the plaintiff.

Howard J. Wayne for the defendant.

This action seeking money due on a promissory note was decided on summary judgment in favor of the plaintiff bank. The defendant claimed a report. The report claims errors identical to those claimed in Cape Cod Bank and Trust Co. v. Linda A. Binder, AKA Linda A. Gerard, 1991 Mass. App. Div. 173. For the reasons stated in that opinion, we dismiss the report in this case.
