Roel CANTU, Appellant v. The STATE of Texas, Appellee
From the 81st Judicial District Court, Atascosa County, Texas
Trial Court No. 11-11-0261-CRA
Honorable Stella Saxon, Judge Presiding
ORDER
The reporter's record was originally due April 15, 2013; however, the court has granted the reporter, Mr. Steve Turner, two extensions of time to file the record until July 29, 2013 — 105 days after it was originally due. When the record was not filed on July 29, 2013, the clerk's office of this court called Mr. Turner and left a message. Mr. Turner did not return the call. A second call was made to Mr. Turner and a second message was left. Still, no response from Mr. Turner. As of the date of this order, the record has not been filed.
We therefore order the court reporter, Mr. Steve Turner, file the record no later than September 16, 2013. Mr. Turner is advised that no further extensions of time will be granted absent a showing of extraordinary circumstances that prevent the timely filing of the record. Mr. Turner is further advised that if the record is not filed by the date ordered, we may order him to appear and show cause why he should not be held in contempt.
We further order the clerk of this court to serve a copy of this order on Mr. Steve Turner by certified mail, return receipt requested and by first class United States mail. Because "[t]he trial and appellate courts are jointly responsible for ensuring that the appellate record is timely filed," TEX. R. APP. P. 35.3(c), we also order the clerk of this court to serve a copy of this order on the trial court.
