On order of the Court, the application for leave to appeal and the application for leave to appeal as cross-appellant from the June 4, 1999 decision of the Court of Appeals are considered, and they are DENIED, because we are not persuaded that the questions presented should be reviewed by this Court prior to the proceedings ordered by the Court of Appeals and any further subsequent review by the Court of Appeals.

Cavanagh and Kelly, JJ., would grant leave to appeal.
