CAN II AG MGT., INC., Petitioner v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER OF DISMISSAL

MARK V. HOLMES JUDGE

This case is on the Court's May 1, 2023 San Francisco, California trial calendar. It's based on a notice of determination from the IRS that it intends to collect unpaid tax through a levy on petitioner's assets. Because it appears to be based on the same notice of determination to the same petitioner as docket number 20547-22, we ordered the parties to show cause why it shouldn't be dismissed for duplication. Respondent filed a reply to our order in which he agreed it should be dismissed; petitioner did not respond. It is therefore

ORDERED that this case is dismissed for duplicativeness.
