STIPULATION AND ORDER CONTINUING PRETRIAL CONFERENCE AND RELATED DEADLINES


Plaintiffs LUIS A. CAMPOS and EDITH VERONICA PEREZ and Defendant CASE, LLC, through their respective counsel of record, stipulate as follows and respectfully request that the Court issue an order continuing the Final Pretrial Conference and related deadlines in conformance herewith:

GOOD CAUSE exists to grant the parties' request to continue the Final Pretrial Conference and related deadlines as the parties have participated in mediation on September 21, 2005, and are currently continuing negotiations in an attempt to resolve this matter prior to trial. In order to provide the parties with adequate time to reach a settlement of this matter prior to the currently scheduled Pre-Trial Conference, the parties hereby request this Court's approval to continue the currently scheduled Pre-Trial Conference and related deadlines as set forth herein.

The parties have made three prior requests for continuances in this case, all of which were granted. Accordingly, Plaintiffs LUIS A. CAMPOS and EDITH VERONICA PEREZ and Defendant CASE, LLC, through their respective counsel, hereby stipulate to the following continuances:

1. Pretrial Disclosures, currently due on October 3, 2005, are rescheduled to be due twenty-one days prior to the rescheduled Final Pretrial Conference;
2. The deadline to meet and confer pursuant to local rules, currently scheduled for October 10, 2005, is rescheduled fourteen days prior to the rescheduled Final Pretrial Conference;
3. The Final Pretrial Order, currently scheduled to be served and lodged on October 17, 2005, is rescheduled to be served and lodged seven days prior to the rescheduled Final Pretrial Conference; and
4. The Final Pretrial Conference before Judge Burns, currently scheduled for October 24, 2005, is rescheduled for a minimum of three weeks until either November 14, 2005 or per the Court's order.
IT IS SO STIPULATED.

ORDER

GOOD CAUSE APPEARING, AND THE PARTIES HAVING SO STIPULATED, IT IS HEREBY ORDERED that the Case Management Conference Order is hereby modified and the previously scheduled Final Pretrial Conference and related deadlines are rescheduled as follows: NO FURTHER EXTENSION REQUESTS WILL BE GRANTED.

1. October 24, 2005 Pretrial Disclosures due;

2. October 31, 2005 Deadline to meet and confer pursuant to local rules;

3. November 7, 2005 Final Pretrial Order to be served and lodged; and

4. November 14, 2005 at 11:15 a.m. Final Pretrial Conference before Judge Burns.

IT IS SO ORDERED.
