Gary CAMPBELL, Appellant v. Amanda LEAL, Appellee

From the 408th Judicial District Court, Bexar County, Texas

Trial Court No. 2012-CI-11077

Honorable Larry Noll, Judge Presiding

ORDER

Sitting: Catherine Stone, Chief Justice

Karen Angelini, Justice

Marialyn Barnard, Justice

Appellant's "Motion to 'Re-Open' and/or Motion for Continuance and Motion to Hire Investigators" is DENIED. This appeal was dismissed for want of jurisdiction on November 21, 2012. No motion for rehearing or motion for en banc reconsideration was filed. A court of appeals retains plenary power over an appeal for sixty days following judgment in the absence of timely filed motions for rehearing. Tex. R. App. P. 19.1(a); see Bass v. Bass, 106 S.W.3d 311, 314 (Tex. App.—Houston [1st Dist.] 2003, no pet.). Accordingly, this court lost jurisdiction over this matter on January 20, 2013. In the absence of jurisdiction, we must deny appellant's motion.

It is so ORDERED on May 6, 2013.

PER CURIAM ATTESTED TO: ________________

Keith E. Hottle

Clerk of Court
