Sonja A. CAMPBELL, Appellant v. Craig GOECKERITZ and Rachel Goeckeritz, Appellees

From the Probate Court No. 2, Bexar County, Texas Trial Court No. 2015PC1378 Judge Sandee Bryan Marion, Judge Presiding

ORDER

Patricia O. Alvarez, Justice

After Appellant filed her notice of appeal, Appellees filed a motion to dismiss the appeal for want of jurisdiction.

Appellees argue that Appellant's request for findings of fact and conclusions of law was neither required nor proper because the trial court dismissed Appellant's suit based on her pleadings. See IKB Indus. (Nigeria) Ltd. v. Pro-Line Corp., 938 S.W.2d 440, 443 (Tex. 1997).

Appellant filed a response, which cited Phillips v. McNeill, 635 S.W.3d 625 (Tex. 2021), and Appellees filed a reply.

Having considered the motion, response, and reply, we order that Appellees' motion to dismiss this appeal for want of jurisdiction is DENIED.

IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the said court on this 5th day of February, 2024.
