G.R. (CORKEY) CAMPBELL, Appellant v. LARRY DEFEVER, Appellee
FROM THE 181ST DISTRICT COURT OF RANDALL COUNTY;
NO. 61,910-B; HON. JOHN BOARD, PRESIDING
Order of Dismissal
Before QUINN, C.J. and HANCOCK and PIRTLE, JJ.
G.R. (Corkey) Campbell filed a notice of appeal on August 2, 2012. We dismiss it for want of prosecution.
The clerk's record was filed on September 4, 2012, and the reporter's record on September 7, 2012. Appellant's brief was due on October 8, 2012. A brief was filed electronically on October 26, 2012, but was rejected because there was no signature, no appendix, and no motion for an extension of time to file the brief. On October 29, 2012, a second attempt was made to file appellant's brief but it was again rejected because the brief was not searchable, the appendix was not bookmarked and did not contain title pages. On October 29, 2012, a motion for extension of time to file the brief was filed but rejected because there was no certificate of conference. The Court notified appellant on November 5, 2012, that the due date for the brief had lapsed, that the brief had not been filed, and that if it was not received by November 15, 2012, the appeal would be dismissed for want of prosecution. To date, no brief or motion to extend the deadline has been filed.
Accordingly, we dismiss the appeal for want of prosecution. TEX. R. APP. P. 38.8(a)(1), 42.3(b). Appellant is free to file a timely motion for rehearing accompanied by a brief and appendix comporting with the Rules of Appellate Procedure.
