Campanur v. State

District Court of Appeal of Florida, Second District
Oct 21, 1994
644 So. 2d 144 (Fla. Dist. Ct. App. 1994)

Opinion

No. 93-02917.

October 21, 1994.

Appeal from the Circuit Court for Highlands County; J. David Langford, Judge.

Wendy E. Friedberg, Orlando, for appellant.

Robert A. Butterworth, Atty. Gen., Tallahassee, and Ron Napolitano, Asst. Atty. Gen., Tampa, for appellee.

Juan Campanur appeals his sentences for multiple convictions following his plea of nolo contendere. He argues that, under Karchesky v. State, 591 So.2d 930 (Fla. 1992), the trial court incorrectly assessed 140 victim injury points. We agree and reverse his sentences.

On remand for resentencing, the trial court shall determine the appropriate victim injury points and impose sentence accordingly.

SCHOONOVER, A.C.J., and THREADGILL and BLUE, JJ., concur.
