ORDER
This Court's opinion and order, entered on March 23, 2023, affirmed in part and vacated in part the trial court's divorce judgment, and remanded for further proceedings. Specifically, the trial court was ordered to determine the value of the tax-loss carry-forward for defendant's business and readjust the property division and spousal support valuation accordingly. This Court retained jurisdiction. On remand, the trial court determined the value of the tax asset and modified the amount of attorney fees, spousal support, and property distribution.
The trial court's August 10, 2023 order concluded the remand proceedings and, thereby, returned the matter to this Court to further consider any remaining issues in the appeal. To that end, appellant may file a supplemental brief, in Docket No. 358463, within 21 days of the transcript of the August 10, 2023 hearing being filed with the Court of Appeals. Appellee may file a supplemental brief within 14 days of service of appellant's supplemental brief.
The Court notes that appellant filed a new claim of appeal from the trial court's August 10, 2023 order on remand, in Court of Appeals Docket No. 367583. In retaining jurisdiction in Docket No. 358463, it was the Court's intention that any appellate issues arising from the remand proceedings would be reviewed by this panel in the same appeal, not by the filing of a new claim of appeal. Therefore, the claim of appeal in Docket No. 367583 is DISMISSED on the Court's own motion under MCR 7.216(A)(7).
