THE COURT:

It is ordered that the opinion filed herein on September 25, 2003, be modified as follows:

The second sentence under the DISPOSITION (p. 6) is modified to read:

The name change and attorney fees are deemed to be a separate order, the order is reversed, and the matter is remanded to the trial court for further proceedings.

Except for the modification set forth above, the opinion previously filed remains unchanged.

This modification does not effect a change in the judgment. Appellants petition for rehearing is denied.
