ORDER

AND NOW, this 26th day of November, 2012, upon careful and independent consideration of the petition for Writ of Habeas Corpus, and after review of the Report and Recommendation of Chief U.S. Magistrate Judge Carol Sandra Moore Wells, it is hereby ORDERED as follows:

1. The Report and Recommendation is APPROVED and ADOPTED;
2. The Petition for Writ of Habeas Corpus, pursuant to 28 U.S.C. § 2254, is DISMISSED and DENIED with prejudice;
3. A Certificate of Appealability will not issue; and
4. The Clerk of Court shall mark this case closed for statistical purposes.

AND IT IS SO ORDERED.
