It is Ordered that the motion of the plaintiff-respondent seeking the dismissal of the appeal is granted without opposition.
It is further Ordered that plaintiff-respondent's application seeking the release of funds is denied on the papers submitted, without prejudice to its renewal upon proof of funds on deposit with the Finance Administrator of the City of New York.
