DECISION & ORDER ON MOTION

Proceeding pursuant to CPLR article 78 to review a determination of a Judge of the County Court, Rockland County, dated March 15, 2021. Motion by the respondent pursuant to CPLR 3211 and CPLR 7804 to dismiss the proceeding as time barred under CPLR 217 and for failure to comply with CPLR 306-b.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied; and it is further, ORDERED that respondent shall serve and file an answer to the petition on or before March 15, 2022.
