This case is currently calendared for trial during the Court's March 7, 2022, Dallas, Texas, trial session. On February 22, 2022, petitioners filed a Motion to Change Place of Trial to Fresno, California. On February 22, 2022, the Court held a conference call with the parties to discuss the current status of the case and petitioners' pending motion. During the call, petitioners informally notified the Court of a change in mailing address.
On February 24, 2022, the Court held a follow-up conference call with the parties and Robert Probasco, Director of the Low-Income Taxpayer Clinic at Texas A&M University School of Law, who at the conclusion of the call agreed to represent petitioners. The parties advised the Court that they intend to request a remote trial if the case is not resolved by agreement.
Upon due consideration, it is hereby
ORDERED that the Clerk of Court shall change petitioners' address in the Court's records to their current address. It is further
ORDERED that this case is stricken from the Court's March 7, 2022, Dallas, Texas, trial session. It is further
ORDERED that petitioners' Motion to Change Place of Trial to Fresno, California, is denied as moot. It is further
ORDERED that, on or before April 25, 2022, the parties shall file with the Court either a joint report (or, if that is not expedient, then separate reports) describing the status of the case or a stipulated decision document. It is further
ORDERED that the undersigned judge retains jurisdiction of this case. 1
