Above defendant's Motion for Partial Relief from Judgment was timely filed and involuntarily misplaced thereafter. No objection was filed. The request is granted and the Clerk is instructed to enter the Amended Judgment as requested, without reference to the last sentence of the Opinion and Order of September 24, 2002 (D.E. #10).

IT IS SO ORDERED.
