Caimano v. Gershkoff Body Radiator Co.

Supreme Court of Rhode Island
Dec 3, 1971
109 R.I. 930 (R.I. 1971)

Opinion

M.P. No. 1579.

December 3, 1971.

Denial of a motion for summary judgment is interlocutory in nature and not finally dispositive of the case and, absent peculiar circumstances, is not appealable under principles applicable in Rhode Island. Any error in denying summary judgment is rendered harmless by a fair determination of the merits at a trial. See 1 Kent, R.I. Civ. Prac., § 56.12.

Motion for leave to file a petition for a writ of certiorari is therefore denied.

DiMascolo DiPetrillo, Anthony DiPetrillo, for Domenic J. Caimano; Edward I. Friedman, Quentin J. Geary, for Benjamin Gross, plaintiffs-respondents.

John F. McDonough, Albert Lisker, for defendant-petitioner, Gershkoff Body and Radiator Co., John G. Carroll, for Robert McGuire, defendant.
