Cagney v. Blaikie

Appellate Division of the Supreme Court of New York, First Department
Sep 14, 1995
219 A.D.2d 483 (N.Y. App. Div. 1995)

Opinion

September 14, 1995

Appeal from the Supreme Court, New York County (Paula Omansky, J.).

The award for past and future pain and suffering materially deviates from what would be reasonable compensation under the circumstances (CPLR 5501 [c]) and we reduce it accordingly. We have considered the defendant's remaining arguments and find them to be without merit.

Concur — Murphy, P.J., Ellerin, Wallach, Rubin and Tom, JJ.
