Present — Finch, P.J., McAvoy, Martin, O'Malley and Townley, JJ.


Order reversed, with ten dollars costs and disbursements, and motion denied, with ten dollars costs, with leave to the defendants to answer within twenty days from service of order upon payment of said costs, on the ground that although the complaint does not state a good cause of action for treble damages under section 273 of the Penal Law, it sufficiently states a cause of action for conspiracy.
