This case is calendared for trial at the session of the Court scheduled to commence on October 23, 2023, for cases in which Fresno, California, is the place of trial.

On August 15, 2023, the Court granted respondent's Motion for Document Subpoena Hearing and scheduled this case for hearing on the status of the case at the Court's September 13, 2023, Washington D.C., special hearing session to be conducted remotely at a date and time certain of 1:00 p.m. (Eastern Time) on Wednesday, September 13, 2023.

On September 8, 2023, respondent filed a Status Report indicating a basis for settlement has been reached, and settlement documents are being prepared to mail to petitioner. Upon due consideration and for cause, it is

ORDERED that this case is hereby stricken from the special hearing session of the Court scheduled to commence on Wednesday, September 13, 2023, at 1:00 p.m. (Eastern Time). It is further

ORDERED that respondent shall notify the third parties VM Credit, Inc., that participation in the Court's remote proceedings scheduled for September 13, 2023, is no longer necessary.
