616 So. 2d 1227 (Fla. Dist. Ct. App. 1993)

Opinion

No. 92-3785.

April 29, 1993.

An Appeal from the Circuit Court for Duval County; Brad Stetson, Judge.

Nancy A. Daniels, Public Defender and Chris Hoeg, Asst. Public Defender, for appellants.

Robert A. Butterworth, Atty. Gen., Gypsy Bailey and Michelle Konig, Asst. Attys. Gen., for appellee.

This is an appeal by two juveniles of delinquency adjudications based on delinquency petitions charging them with escape. We have previously decided the exact issue raised in this appeal in R.A.H. v. State, 614 So.2d 1189 (Fla. 1st DCA 1993). Accordingly, we reverse appellants' adjudications of delinquency and remand the matter to the lower tribunal with directions that the charges of escape be dismissed.

SMITH, ZEHMER and ALLEN, JJ., concur.
