DECISION & ORDER ON MOTION

Motion by appellant for an enlargement of time to serve and file papers in reply to respondent's opposition to appellant's prior motion for leave to reargue an appeal from a judgment of the Civil Court of the City of New York, Queens County, entered July 1, 2009, which appeal was determined by a decision and order of this court dated January 14, 2013, or, in the alternative, for leave to appeal to the Appellate Division from the decision and order of this court.

Upon the papers filed in support of the motion, and no papers having been filed in opposition thereto, it is

ORDERED that the motion is denied as moot.

Appellant's motion for leave to reargue his appeal or, in the alternative, for leave to appeal to the Appellate Division, was decided by decision and order of this court dated March 21, 2013.
