No. 98-3140.
November 20, 1998.
Petition for Writ of Prohibition — Original Jurisdiction.
Monica K. Reimer, Assistant Attorney General, Tallahassee, for petitioner Robert A. Butterworth, Attorney General.
David G. Guest, and S. Ansley Samson, Earth-justice Legal Defense Fund, Tallahassee, for petitioners Sierra Club, Florida Chapter; Florida Wildlife Federation, Inc.; and Florida Audubon Society, Inc.
David C. Schwartz, Assistant General Counsel, Executive Office of the Governor, Tallahassee, for petitioner Administration Commission.
John W. Costigan, Deputy General Counsel, and Andrew J. Baumann, Assistant General Counsel, Tallahassee, for petitioner Department of Environmental Protection.
Robert J. Angerer, and Robert J. Angerer, Jr., of Angerer Angerer, Tallahassee, for respondent Coastal Petroleum Company.
No appearance for respondent St. George Island Civic Club.
The Department of Environmental Protection has entered a final order which denied the permit sought by Coastal Petroleum. That action renders moot the administrative proceeding to set the amount of the surety to be posted as a condition of the permit. Therefore, the petition for writ of prohibition is GRANTED.
BOOTH, BENTON and PADOVANO, JJ., concur.
