Jacob Busbee, Appellant v. The State of Texas, Appellee

FROM THE 403RD DISTRICT COURT OF TRAVIS COUNTY
NO. D-1-DC-19-904034 , THE HONORABLE BRENDA KENNEDY, JUDGE PRESIDING ORDER

PER CURIAM

On July 23, 2020, the Court abated this appeal and remanded the matter to the trial court to conduct a hearing to determine whether appellant desires to prosecute this appeal and, if so, whether counsel has abandoned this appeal. See Tex. R. App. P. 38.8(b)(2), (3). We sent notice of the order and memorandum opinion to appellant's counsel, Kenneth G. Mahaffey, who had filed the notice of appeal on appellant's behalf, as well as a motion for extension of time to file appellant's brief. After the Court issued the July 23, 2020 order and memorandum opinion abating and remanding the appeal, we were informed by the trial-court clerk that Gary Prust was appointed to represent appellant in this appeal on February 12, 2020. Because Prust has not received any noticing related to the appeal, we withdraw our July 23, 2020 order and memorandum opinion, reinstate the appeal, and order Prust to file appellant's brief or a motion for extension of time to file appellant's brief on or before August 31, 2020.

It is ordered on July 30, 2020. Before Justices Goodwin, Triana, and Smith Do Not Publish
