Decedents' estates — Gifts — Inter vivos — Evidence — Insufficiency.

In this case it was Held that appellant's evidence failed to establish a gift inter vivos of money on deposit in the decedent's savings account.

Before JONES, C. J., BELL, MUSMANNO, JONES, COHEN, BOK and EAGEN, JJ.

Appeal, No. 64, March T., 1961, from decree of Orphans' Court of Cambria County, No. 35952, in re matter of estate of Michael Busavich, deceased. Decree affirmed.

Petition to show cause why bank account should not be paid to petitioner. Before NELSON, P. J.

Petition dismissed and decree entered. Petitioner appealed.

The court below correctly held that the evidence adduced by Anna Ganis, the appellant, failed to establish a gift inter vivos to her of the money on deposit in the decedent's savings account and that the funds in the account were the sole and absolute property of the decedent at the time of his death and, therefore, belong to his estate.

Decree affirmed at appellant's costs.
