ORDER MODIFYING OPINION AND DENYING REHEARING

THE COURT:

1. On page 8, in the second sentence of the second full paragraph, delete the words "sufficiently compact the soil" and replace with "excavate and remediate the entire area of the lots" so the sentence now reads:

"Substantial evidence, including expert opinion, supported a finding that Turf did not excavate and remediate the entire area of the lots, resulting in damage from settling soil."

Appellant's petition for rehearing is denied.

There is no change in judgment.
