Opinion Filed May 28, 2003.
On Appeal from the County Court at Law No. 3, Dallas County, Texas, Trial Court Cause No. CC-02-14856-C.
DISMISS.
Before Justices MORRIS, WRIGHT, and MOSELEY.
MEMORANDUM OPINION
The clerk's record was due to be filed in this appeal on March 30, 2003 and has not been filed. By letter dated March 5, 2003, this Court received written notification from the county clerk that the record has not been filed because the record fee of $36 has not been paid. By letter dated April 14, 2003, this Court cautioned appellants that the appeal could be dismissed if they did not provide written verification that they had made payment or payment arrangements for the clerk's fee or were entitled to proceed without payment of costs. See Tex.R.App.P. 37.3(b). Appellants did not respond to the Court's letter.
In a second letter dated May 7, 2003, the Court again directed appellants to file written verification that they had made payment or payment arrangements for the clerk's fee or were entitled to proceed without payment of costs. The Court informed appellants that failure to provide the required information within ten days would result in the dismissal of the appeal without further notice. Appellants have failed to respond.
Therefore, on the Court's own motion, this appeal is DISMISSED for want of prosecution. See Tex.R.App.P. 37.3(b), 42.3(b), (c).
