Appellate cause number 05-24-00559-CV challenges a judgment made final after severance of an unadjudicated Texas Open Meetings Act ("TOMA") claim. Appellate cause number 05-24-01298-CV challenges the judgment of the since- adjudicated TOMA claim, which was assigned trial court cause number 416-01038-2024 upon severance. The brief in cause number 05-24-00559-CV is overdue; the brief in cause number 05-24-01298-CV is due December 12, 2024.
Before the Court is appellants' unopposed motion, filed in appellate cause number 05-24-00559-CV, to consolidate the two appeals and extend the deadline for filing their brief in that appeal. Because the appeals have different trial court cause numbers, we GRANT the motion TO THE EXTENT we DESIGNATE appellate cause number 05-24-01298-CV as a companion appeal to appellate cause number 05-24-00559-CV, ORDER the appeals submitted together, and RESET the deadline for appellants' brief in each appeal to January 13, 2025. The parties may file a single brief and may reference the record in both appeals.
