Burkhart v. Emmons

Court of Appeals of the State of New York
Feb 23, 1995
85 N.Y.2d 853 (N.Y. 1995)

Opinion

Submitted December 19, 1994

Decided February 23, 1995

Motion, insofar as it seeks leave to appeal from that portion of the Appellate Division order that affirmed that part of Supreme Court's order denying plaintiff's motion to amend his complaint, dismissed upon the ground that that part of the order sought to be appealed from does not finally determine the action within the meaning of the Constitution; motion for leave to appeal otherwise denied.
