ANDREW BURKE, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 458th District Court Fort Bend County, Texas Trial Court Cause Nos. 22-DCR-099866

Panel Consists of Chief Justice Christopher and Justices Zimmerer and Wilson.

CONTINUING ABATEMENT ORDER

ER CURIAM.

On March 7, 2024, we abated this appeal and ordered the trial court to hold a hearing on appellant's request for new counsel and further ordered that reporter's record and supplemental clerk's record associated with that hearing be filed with this court by April 8, 2024. Although the record reflects that the trial court timely held the hearing and an associated supplemental clerk's record was timely filed with this court, the reporter's record of that hearing has not been provided. Accordingly, we reorder that the reporter's record of the hearing be filed with this court by May 28, 2024.

The appeal remains abated, treated as a closed case, and removed from this court's active docket. The appeal will be reinstated on this court's active docket after the requested reporter's record is filed in this court.
