ORDER

ELIZABETH A. COPELAND, JUDGE.

This case is calendared for trial at the Trial Session of the Court scheduled to commence on April 17, 2023, in Cleveland, Ohio.

On February 16, 2023, petitioner filed with the Court a Motion for Partial Summary Judgment. On February 23, 2023, petitioner filed with the Court a First Amendment to Motion for Partial Summary Judgment, which also ratified the initial motion. On March 7, 2023, the Court issued an Order requiring a response to petitioner's Motion for Partial Summary Judgment from respondent on or before April 5, 2023. On March 13, 2023, the parties filed with the Court a Proposed Stipulated Decision.

Upon due consideration, and for cause, it is

ORDERED that petitioner's Motion for Partial Summary Judgment, filed on February 16, 2023, and as ratified and amended on February 23, 2023, is denied as moot. It is further

ORDERED that the Court's Order dated March 7, 2023, is hereby vacated, and no response is due from respondent.
