This case is calendared for trial at the June 4, 2024, Burlington, Vermont, Trial Session of the Court.

On April 19, 2024, respondent filed a Motion to Substitute Parties and Change Caption (motion), seeking to have the Court substitute Brittni Burke, petitioner's executor, as a party in this case and change the caption. In his motion respondent asserted that petitioner John F. Burke passed away on March 2, 2023, which was after the filing of the Petition. Petitioner's executor, Brittni Burke does not object to the granting of respondent's motion. Upon due consideration, it is

ORDERED that respondent's Motion to Substitute Parties and Change Caption, filed April 19, 2024, is granted. It is further

ORDERED that the caption of this case is amended to read: "Estate of John F. Burke, Deceased, Brittni Burke, Executor, Petitioner v. Commissioner of Internal Revenue, Respondent."
