RONALD ANTHONY BURGOS-AVILES, Appellant, v. THE STATE OF TEXAS, State.

Appeal from the 49th District Court of Webb County, Texas (TC# 2018CRA000852D1)

Before Alley, C.J., Palafox and Soto, JJ.

ORDER

PER CURIAM

The reporter's record in this appeal was originally due January 14, 2024. On January 12, 2024, reporter Cynthia Perez Lenz filed an extension request citing health concerns. This Court granted the extension request.

However, because of the health concerns cited in her extension request, the Court finds that an abatement is necessary. This cause is abated for thirty (30) days and remanded to the trial court. The trial court is ordered to conduct a hearing and make findings as to the likely length of the delay that will be occasioned by the health condition, and whether any additional resources, such as a second reporter, might assist in the preparation of the record.

The findings shall be filed in a supplemental clerk's record within thirty (30) days of the date of this order. The appellate timetables shall be suspended during the abatement, and this cause shall be reinstated thirty (30) days from the date of this order, or once a supplemental clerk's record is filed, whichever occurs sooner.

IT IS SO ORDERED.
