Appeal from the decision by the defendant approving an application to subdivide certain real property, brought to the Superior Court in the judicial district of Tolland, and tried to the court, O'Neill, J.; judgment for the plaintiffs, from which the defendant appealed to this court; thereafter, the plaintiffs filed a motion to dismiss. Motion granted; appeal dismissed.

Ralph J. Alexander, town attorney, with whom, on the brief, was Richard M. Rittenband, former town attorney, for the appellant (defendant).

Ronald P. Sherlock, with whom, on the brief, was James W. Sherman, for the appellees (plaintiffs).


Subsequent to the oral argument in this appeal, the plaintiffs moved to dismiss the appeal on the ground of mootness. On the basis of the briefs of the parties on the motion, and on the hearing held thereon, we conclude that the appeal is moot.
