7 A.D.3d 744 (N.Y. App. Div. 2004)

Opinion

2003-06893.

Decided May 24, 2004.

In an action to recover damages for personal injuries, the plaintiff appeals from an order of the Supreme Court, Queens County (LeVine, J.), dated April 15, 2003, which granted the defendants' motion for summary judgment dismissing the complaint.

Kahn Gordon Timko Rodriques, P.C., New York, N.Y. (Thomas B. Grunfeld of counsel), for appellant.

Shapiro, Beilly, Rosenberg, Aronowitz, Levy Fox, LLP, New York, N.Y. (Roy J. Karlin of counsel), for respondents.

Before: GABRIEL M. KRAUSMAN, J.P., DANIEL F. LUCIANO, BARRY A. COZIER, ROBERT A. SPOLZINO, JJ.

DECISION ORDER

ORDERED that the order is reversed, on the law, with costs, and the motion is denied.

There are issues of fact requiring the denial of summary judgment.

KRAUSMAN, J.P., LUCIANO, COZIER and SPOLZINO, JJ., concur.
