Opinion
March 9, 1949.
Appeal from Supreme Court.
Present — Foster, P.J., Heffernan, Brewster, Santry and Bergan, JJ.
The actions arose out of a collision which occurred on September 7, 1947, between two automobiles on the Glens Falls-Lake George highway, one owned by plaintiff in the first action and operated by his deceased son and one owned by defendant, George S. Jamison and operated by his son Graham Jamison. Upon conflicting evidence the jury found that the collision was due to the negligence of the operator of the Jamison car and the evidence justifies that finding. There are no errors of law which require a reversal. Judgment and order in favor of plaintiff in the Burdick action are unanimously affirmed, with one bill of costs and disbursements to plaintiff in the action of the administrator against the defendants, and the judgment and order in the Jamison action are unanimously affirmed, without costs.
