This case is on the calendar of the Court's March 6, 2023 trial session for Richmond, Virginia (Charlottesville). Pending before the Court is respondent's Motion to Dismiss for Lack of Prosecution (Doc. 9), and petitioners' Motion for Continuance (Doc. 11). The motions are set for hearing at the above-mentioned trial session. On February 27, 2023, respondent filed a Motion to Withdraw Respondent's Motion to Dismiss for Lack of Prosecution (Doc. 13). In the motion, respondent advised that the Motion to Dismiss for Lack of Prosecution is no longer needed and that respondent does not object to the granting of petitioners' Motion for Continuance.

Upon due consideration, it is

ORDERED that respondent's Motion to Withdraw Respondent's Motion to Dismiss for Lack of Prosecution is granted. It is further

ORDERED that respondent's Motion to Dismiss for Lack of Prosecution is hereby withdrawn. It is further

ORDERED that petitioners' Motion for Continuance is granted and this case is stricken from the Court's March 6, 2023, trial calendar for Richmond, Virginia and is continued generally.
