168 So. 2d 696 (Fla. Dist. Ct. App. 1964)

Opinion

No. 64-24.

November 3, 1964.

Appeal from the Circuit Court for Monroe County; Aquilino Lopez, Jr., Judge.

W. Curry Harris and Robert Youmans, Key West, for appellant.

James W. Kynes, Jr., Atty. Gen., and Leonard R. Mellon and Victor V. Andreevsky, Asst. Attys. Gen., for appellee.

Before BARKDULL, C.J., and HORTON and HENDRY, JJ.

By this appeal, appellant seeks review of an order of the trial court denying his motion, filed pursuant to Criminal Procedure Rule 1, F.S.A., ch. 924 Appendix.

We have examined the record on appeal and considered the points of law presented by appellant's brief in the light of the assignments of error. We find appellant's contentions to be without merit and the order appealed should be affirmed.

Affirmed.
