DECISION & ORDER ON MOTION

Motion by appellant to stay enforcement of a judgment of the Justice Court of the Town of Minisink, Orange County, entered December 22, 2016, pending the determination of an appeal from an order of that court dated July 13, 2017.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the motion is granted on condition that the appeal be perfected by November 3, 2017; and it is further,

ORDERED that in the event that the above condition is not met, the court, on its own motion, may vacate the stay, or respondent may move to vacate the stay on three days' notice.
