On order of the Court, the application for leave to appeal the April 14, 2016 order of the Court of Appeals is considered and, pursuant to MCR 7.305(H)(1), in lieu of granting leave to appeal, we REMAND this case to the Court of Appeals as on reconsideration granted to address the issue whether the defendant waived its right to assert a defense based on MCL 500.3106(1) by failing to plead the effect of that statute as an affirmative defense in its responsive pleading.
