Opinion

Civil No. 2:03-CV-269.

June 30, 2004

DAVID E. YOCOM, District Attorney for Salt Lake County DON HANSEN, NICK D'ALESANDRO, Deputy District Attorneys, Salt Lake City, Utah, Attorneys for Salt Lake County Defendants.

KEVIN M. SCHEFF Attorney for Plaintiff.

ORDER JOINT STIPULATED MOTION TO POSTPONE TRIAL

Defendants SALT LAKE COUNTY, SALT LAKE COUNTY SHERIFF'S OFFICE, and DEPUTY J. LEE, by and through their counsel of record, Don Hansen and Nick D'Alesandro, Deputy Salt Lake County District Attorneys, and plaintiff DAME ALMA BULKLEY, by and through his attorney, Kevin M. Scheff, hereby jointly stipulate and move the court for an order postponing and rescheduling the trial currently scheduled in this action to begin January 10, 2005.

The grounds for this motion are that defendants' attorney, Don Hansen, presently has a three-week trial scheduled in federal court to begin the same day ( i.e., January 10, 2005) before Judge Paul Cassell in the case of Dale M. Gibbons v. Lambert, et. al., U.S. District Court No. 2:02-CV-1244PGC. The Gibbons trial date has been set since last February.

The parties hereby further request a brief scheduling conference with the court, either by telephone or by in-court hearing, for the purpose of rescheduling the trial date herein.
