MEMORANDUM OPINION


Appellant's brief was due to be filed by September 27, 2004. Neither the brief nor a motion for extension of time have been filed. Accordingly, on October 11, 2004, this court ordered appellant to show cause in writing no later than October 18, 2004 why this appeal should not be dismissed for want of prosecution. See Tex.R.App.P. 38.8(a). Appellant did not respond. The appeal is dismissed for want of prosecution. See Tex.R.App.P. 38.8(a)(1), 42.3(b). Costs of appeal are taxed against appellant.
