LIMITATIONS OF ACTION, § 40complaint for alleged fraud and conspiracy in procuring purchase of realty as barred by five-year statute. Complaint's count, which charged defendants with fraud and conspiracy in procuring plaintiffs to purchase certain realty, held barred by five-year statute of limitations (Ill. Rev. Stat. 1939, ch. 83, pars. 16, 23, 24a; Jones Ill. Stats. Ann. 107.275, 107.282, 107.284(1).

Appeal from the Superior Court of Cook county; the Hon. M.L. McKINLEY, Judge, presiding.

Affirmed in part, reversed in part and remanded with directions. Heard in the second division, first district, this court at the December term, 1941.
