ON RETURN TO REMAND


On remand, the trial judge set aside Buchannon's conviction of burglary in the first degree, adjudged him guilty of burglary in the third degree, and sentenced him as a habitual offender to thirty-five years' imprisonment. The judgment of the Lee Circuit Court is hereby affirmed.

OPINION EXTENDED;

AFFIRMED.

All Judges concur.
