Opinion

No. 258 2013.

2013-07-25

David J. BUCHANAN, Petitioner Below, Appellant, v. Barbara H. RICHARDS, Respondent Below, Appellee.

Court Below—Family Court of the State of Delaware, in and for Sussex County, File No. CS94–3107, Pet. Nos. 13–10049 and 08–07771.
Before BERGER, JACOBS and RIDGELY, Justices.

ORDER

JACK B. JACOBS, Justice.

This 25th day of July 2013, it appears to the Court that, on June 18, 2013, this Court denied appellant's motion to proceed in forma pauperis and directed him to pay the filing fee on or before July 3, 2013. The appellant has failed to pay the required filing fee. Accordingly, this appeal is dismissed for the appellant's failure to diligently prosecute the appeal.

NOW, THEREFORE, IT IS HEREBY ORDERED, pursuant to Supreme Court Rule 29(b), that this appeal is DISMISSED. The motion to affirm is moot.
