Appellants filed an opposed motion to consolidate this permissive appeal, Appellate Cause No. 04-24-00521-CV, with another permissive appeal, Appellate Cause No. 04-24-00516-CV, and an original proceeding, Appellate Cause No. 04-24-00762-CV. All three matters arise from the same underlying trial court proceeding. After considering the motion and the records on file, this court has determined that Appellate Cause Nos. 04-24-00516-CV and 04-24-00521-CV should be consolidated for briefing and oral argument, if granted. However, this court has determined the original proceeding filed in Appellate Cause No. 04-24-00762-CV should not be consolidated with the other permissive appeals.

In accordance with our order issued in Appellate Cause No. 04-24-00516-CV, we GRANT IN PART the motion to consolidate and ORDER the permissive appeals filed in Appellate Cause Nos. 04-24-00516-CV and 04-24-00521-CV consolidated for the purpose of briefing and oral argument, if any. The parties shall file all motions, briefs, and other documents as if the appeals were one case but shall include both appeal numbers in the style. If oral argument is granted, the consolidated appeals will be argued together as a single appeal and the total time limit for oral argument shall equal the ordinary time limit for a single appeal. The court will dispose of both appeals with the same judgment, opinion, and mandate.

The motion to consolidate the original proceeding filed in Appellate Cause No. 04-24-00762-CV with the other permissive appeals is DENIED.
