VIRGIL BRYANT III, Appellant v. THE STATE OF TEXAS, Appellee

From the 443rd District Court Ellis County, Texas Trial Court No. 48897CR

Before Chief Justice Gray, Justice Johnson, and Justice Smith, J.

REINSTATEMENT ORDER

PER CURIAM.

This appeal was abated and remanded so the trial court could determine why a brief had not been filed in this case and whether Appellant still desires to proceed with this appeal. The trial court held a hearing and the supplemental clerk's record and supplemental reporter's record of that hearing have been filed in this Court. The trial court found that Appellant wishes to proceed with the appeal, and he is receiving effective assistance of counsel. The trial court recommended giving counsel until September 27, 2024 to file Appellant's brief.

Accordingly, we REINSTATE this appeal.

We ORDER that Appellant's brief is due on or before September 27, 2024.

The State's brief will then be due thirty days after Appellant's brief is filed.

Appeal reinstated.
