Bryant v. State

District Court of Appeal of Florida, Fourth District
Nov 8, 1978
364 So. 2d 64 (Fla. Dist. Ct. App. 1978)

Opinion

No. 77-1270.

November 8, 1978.

Appeal from Circuit Court, Broward County; M. Daniel Futch, Jr., Judge.

Richard L. Jorandby, Public Defender, and Allen J. DeWeese and Kathleen J. Kroll, Legal Intern, West Palm Beach, for appellant.

Robert L. Shevin, Atty. Gen., Tallahassee, and Joy B. Shearer, Asst. Atty. Gen., West Palm Beach, for appellee.

The recent decision of the Florida Supreme Court in Clark v. State, 363 So.2d 331 (Fla. 1978), is controlling as to the issue of improper comment concerning the defendant's exercise of his right to remain silent. The court has considered appellant's remaining issue and finds it without merit.

AFFIRMED.

CROSS and MOORE, JJ., and PAUL, MAURICE M., Associate Judge, concur.
